Permission has been given to convert offices in Newbury’s Bartholomew Street into 18 flats at Berkshire House.
The applicant obtained a change of use from commercial, business and service offices because the scheme falls within permitted development rights. They applied for a lawful development certificate — if the local planning authority is satisfied the appropriate legal tests are met, it must grant the certificate.
Planning merits are not relevant to this application or appeal process. There is no statutory requirement to consult third parties, including parish councils or neighbours, and views expressed by third parties on the planning merits or on whether the applicant has any private rights are irrelevant when determining the application.
Berkshire House stopped being used as offices in March last year.
