A High Court hearing has been set between West Berkshire Council and a group of travellers over an illegal development near AWE's Aldermaston site.
The council says it wants to prosecute those responsible, despite a temporary stop notice. It won an injunction in December stopping further development and occupation south of Reading Road.
The case was due to finish this month but didn't conclude; a one-day hearing is now set for July 8 at the High Court.
AWE's Aldermaston site, along with nearby Burghfield, plays a key role in the country's Trident defence programme.
Hundreds have signed an online petition saying the work has left others feeling "unsafe, anxious and unprotected".
The council says neither it nor the police have legal powers to remove people or items from the land and that civil legal processes must be followed. A spokesperson said: "The temporary stop notice remains in force," "Any activity that breaches it is a criminal offence, and officers are continuing to gather evidence to support potential prosecution."
